You must be 18 years or older to use Shaku.

Users under 18 may only use the App with the consent and supervision of a parent or legal guardian. By using the App, you confirm that you meet these requirements or have the required consent.

Shaku provides software services designed to assist with clothing size estimation, body measurement, garment measurement, wardrobe management, outfit planning, clothing search, and product discovery.

Through the App, SDK, API integrations, Shopify plugin, and related services, Shaku may provide:

• Secure user authentication
• AI-based body measurement tools
• AI-based garment measurement tools
• Size recommendations for clothing items
• Wardrobe and outfit management features
• Clothing search through text, images, or other inputs
• Product recommendations and affiliate shopping links
• Access to measurement results
• Integration with websites, retailers, merchants, or partner applications

Shaku provides technology services only. Shaku does not manufacture, own, sell, ship, fulfill, or control clothing products shown through the App.

We grant you a limited, non-transferable, non-exclusive, revocable license to use the App for personal, lawful, and permitted purposes, including:

• Body measurement
• Garment measurement
• Size recommendation
• Wardrobe management
• Outfit planning
• Searching clothing through text, images, or other inputs
• Viewing affiliate product results
• Saving preferences, clothing items, or wardrobe information

You agree not to:

• Reverse engineer, copy, modify, or attempt to extract the source code of the App
• Misuse, exploit, overload, or interfere with the App or AI systems
• Use the App for unlawful, harmful, fraudulent, or abusive purposes
• Attempt to bypass security, authentication, or usage limits
• Scrape, copy, or automatically collect data from the App without permission
• Manipulate affiliate links, product clicks, referrals, or commission tracking
• Interfere with our servers, APIs, systems, or third-party integrations

To use certain features, you may need to create an account.

You are responsible for:

• Providing accurate and current account information
• Keeping your password and login credentials secure
• All activity that occurs under your account
• Notifying us if you believe your account has been accessed without permission

Shaku is not responsible for losses caused by unauthorized access to your account if you failed to keep your login information secure.

You may delete your account at any time through the App or by contacting us.

Shaku provides AI-generated body measurements, garment measurements, and size recommendations on a best-effort basis.

Shaku cannot guarantee perfect sizing or measurement accuracy because results may depend on many factors, including:

• Photo quality
• Lighting
• Camera angle
• Device positioning
• Body posture
• Clothing visibility
• Height information
• Garment placement
• Retailer size charts
• Product design and fit
• Fabric stretch
• Brand sizing differences
• Retailer product data changes

Users are responsible for following Shaku's photo and measurement guidelines. Shaku is not responsible for inaccurate results caused by unclear images, incorrect height information, poor lighting, camera tilt, covered body areas, loose clothing, distorted photos, incorrect garment placement, or failure to follow instructions.

Shaku's size recommendations are informational only. You are responsible for reviewing product details, retailer size charts, return policies, and your own fit preferences before purchasing any item.

Shaku is not responsible for:

• Incorrect size recommendations
• Product fit issues
• Retailer size chart errors
• Return costs
• Exchange costs
• Alteration costs
• Purchase decisions made based on App results

To provide measurement and image-based search features, the App may request access to your camera, photos, storage, or device functionality.

Camera access may be used for:

• Body measurement
• Garment measurement
• Image-based clothing search
• Uploading or scanning clothing items
• Generating AI-based recommendations

By enabling these permissions, you authorize Shaku to process the relevant images and device data for the purposes described in these Terms and in our Privacy Policy.

You may disable permissions through your device settings, but some App features may not function properly.

Shaku may display clothing items, product recommendations, advertisements, sponsored results, and shopping links from third-party retailers, affiliate networks, and partner platforms. These may include, but are not limited to, affiliate networks, brand affiliate programs, retailer product feeds, and other affiliate or advertising partners.

Some links in the App are affiliate links. This means that if you click a product link and make a purchase through a third-party retailer, Shaku may receive a commission or referral fee at no additional cost to you.

Shaku does not own, sell, ship, fulfill, or control any third-party products shown in the App. All product information, including price, availability, descriptions, images, sizes, delivery options, return policies, and promotions, is provided by third-party retailers or affiliate partners and may change without notice.

You acknowledge that:

• Product details may not always be accurate, complete, or up to date
• Retailers are responsible for product quality, pricing, shipping, returns, refunds, exchanges, taxes, and customer service
• Your purchase is made directly with the external retailer, not with Shaku
• Shaku is not responsible for purchases, disputes, delays, returns, refunds, product defects, or retailer actions outside the App
• Clicking an affiliate link may redirect you to a third-party website or app, which is governed by that third party's own terms, privacy policy, cookie policy, and purchase conditions

Shaku may personalize product recommendations based on your search activity, style preferences, saved items, body measurements, size recommendations, or other information you provide, where permitted by law and in accordance with our Privacy Policy.

Affiliate relationships do not guarantee that a product is suitable for you. You are responsible for reviewing the retailer's product details, size chart, price, shipping terms, return policy, and other purchase information before buying.

Shaku participates in affiliate marketing programs. This means we may earn commissions when users click certain product links or purchase products from third-party retailers through the App.

Some product links, buttons, banners, recommendations, or shopping results may be affiliate links.

Affiliate commissions help support the operation, development, and improvement of the App. These commissions do not increase the price you pay for products.

We aim to display relevant product recommendations, but affiliate partnerships may influence which retailers, products, or offers are available in the App. Shaku does not guarantee that displayed products are the cheapest, best, most suitable, or always available.

Where required, affiliate links or sponsored content may be marked using labels such as "Paid link," "Affiliate link," "Sponsored," "Ad," "Partner link," or similar wording.

If you use Shaku through a partner website, retailer, merchant, Shopify store, SDK, API, or integrated application, measurement results or size recommendation data may be shared with that partner where necessary to provide the service.

Merchants and retailers cannot access uploaded measurement images stored by Shaku unless explicitly stated and separately consented to.

Shaku does not share your Shaku password with merchants or retailers.

Retailers may receive only the data required to provide size recommendations, product recommendations, or related shopping functionality, and only where permitted by law or based on your action or consent.

Some Shaku features may be offered as paid subscriptions, premium features, or in-app purchases.

Payments may be processed by third-party payment providers, app stores, or billing platforms, including Apple App Store, Google Play, Stripe, Shopify billing, or direct invoicing where applicable.

Shaku does not directly store full payment card details. Payment processors handle payment information according to their own terms and privacy policies.

Subscription cancellation, refunds, renewals, and billing disputes may be subject to the rules of the payment provider or app store used for the purchase.

We may monitor usage of the App, affiliate links, product clicks, API requests, measurement services, and account activity to detect fraud, abuse, invalid traffic, automated activity, security threats, or violations of these Terms.

We may suspend, restrict, or terminate accounts or access if we detect:

• Misuse of the App
• Fraudulent activity
• Scraping
• Automated clicking
• Manipulation of affiliate links
• Invalid traffic
• Unauthorized API use
• Attempts to interfere with Shaku systems
• Violation of third-party affiliate program rules

Shaku strives to provide reliable service, but we do not guarantee uninterrupted, secure, or error-free operation.

The App or Services may be temporarily unavailable due to:

• Maintenance
• Technical issues
• Security updates
• Server or cloud provider issues
• Third-party platform dependencies
• Retailer, affiliate, API, Shopify, or external service disruptions

Shaku is not responsible for losses or issues caused by temporary service interruptions or third-party platform failures.

Your use of the App is governed by the Shaku Privacy Policy.

By using the App, you acknowledge that Shaku may collect and process personal information as described in the Privacy Policy, including:

• Account information
• Photos used for measurement or search
• Body measurement data
• Garment measurement data
• Search and shopping activity
• Product clicks and affiliate link activity
• Device and technical data
• Usage and diagnostic data

Shaku uses security measures such as encryption, access controls, secure authentication, and on-device face blurring where applicable.

We may suspend, restrict, or terminate your access to the App if:

• You violate these Terms
• You misuse the App
• You engage in fraud, abuse, or unauthorized activity
• Your use creates risk for Shaku, users, partners, or third parties
• Required by law or by a third-party platform

You may terminate your account at any time.

After termination, certain provisions of these Terms will continue to apply, including disclaimers, limitations of liability, intellectual property rights, affiliate terms, and privacy-related provisions.

Shaku, including its software, algorithms, designs, branding, logos, text, graphics, interfaces, measurement tools, AI models, and related technology, is owned by Shaku or its licensors.

You may not copy, modify, distribute, sell, license, reverse engineer, or create derivative works from any part of Shaku without our written permission.

Third-party retailer names, logos, trademarks, and product images belong to their respective owners.

Shaku is provided "as is" and "as available."

We do not guarantee:

• Continuous operation
• Error-free performance
• Perfect sizing accuracy
• Perfect measurement accuracy
• Availability of affiliate products
• Accuracy of third-party retailer information
• That products shown will meet your expectations
• That third-party websites or retailers will operate correctly

To the maximum extent permitted by law, Shaku disclaims all warranties, express or implied.

To the maximum extent permitted by law, Shaku is not liable for:

• Incorrect size recommendations
• Incorrect body or garment measurements
• Product issues from retailers
• Retailer shipping, return, refund, or customer service issues
• Lost profits or indirect damages
• Data loss after account deletion
• Service interruptions
• Affiliate tracking errors
• Third-party website or app issues
• Unauthorized account access caused by your failure to protect your login credentials

To the maximum extent permitted by law, Shaku's total liability shall not exceed $50 CAD.

We may update these Terms from time to time. If we make important changes, we may notify you through the App, by email, or by posting an updated version.

Your continued use of the App after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of Ontario, Canada, and applicable federal laws of Canada.
